By using this website, submitting a form, booking a service, purchasing a product, accepting a proposal, paying an invoice or deposit, or permitting work to begin, you agree to the applicable written project terms and these website terms to the extent they do not conflict with a signed agreement.
For design, installation, stewardship, consultation, or other property services, the applicable signed proposal, contract, invoice, or service agreement controls if it differs from this page. Bring Back Eden proposals, invoices and service agreements incorporate these terms by reference.
Privacy policy

Information may include your name, contact information, property and project details, booking information, purchases, form submissions, photographs or files you provide, communications, and website usage data.
We may use trusted third-party service providers for website hosting, scheduling, payments, analytics, email, newsletters, CRM, project management, cloud storage, accounting, automation, and related business operations.
Payment information is generally processed by third-party payment providers. Bring Back Eden does not intentionally store full payment-card information outside secure payment systems.
We may use cookies, pixels, and analytics tools to understand website traffic, improve performance, and measure marketing effectiveness.
Bring Back Eden does not sell personal information for money.
If you give us your phone number, you agree that we may call or text you about your inquiry, booking or project. Message and data rates may apply. Reply STOP to any text to opt out. We do not send marketing texts without your consent.

Subject to applicable law and legitimate business recordkeeping requirements, you may request access to, correction of, or deletion of personal information we maintain.
Bring Back Eden does not automatically receive permission to publicly identify a private client, residence, address, household, or other private property information simply because services were performed there.
Services, pricing & consultation credits
Website pricing is general guidance and may change. Final project pricing is determined by the applicable written proposal or agreement.
Site Consultation fees may be applied toward qualifying full Bring Back Eden Design + Build projects of $14,000 or more when the client moves forward. Consultation credits do not apply to the $4,997 Eden Launch Zone, the $9,997 Eden Expansion Zone, standalone design services, stewardship services, or third-party costs.
Standalone Design Blueprints are separately priced professional services. For full Design + Build projects, professional design is incorporated into the overall project scope and investment.
Estimates, scope & additional work
Website estimates, calculators, pricing ranges, social-media statements, and informal conversations do not replace a written proposal.
Final pricing may be affected by property size, site access, soil, drainage, irrigation, grading, plant availability, materials, labor, equipment, travel, permitting, HOA requirements, weather, and conditions discovered after work begins.
Work outside the agreed scope may require additional approval, pricing, or a written change order.
Client responsibilities
Clients are responsible for providing accurate property information and disclosing known conditions that may affect the work, including private utilities and irrigation, septic systems, drainage infrastructure, easements and property boundaries, HOA restrictions, permit requirements, buried structures, access limitations, and known hazards.
Unless specifically included in writing, Bring Back Eden is not responsible for surveying property boundaries, locating private utilities, obtaining engineering reports, or identifying concealed conditions.
Clients are responsible for providing reasonable site access and for following watering, irrigation, maintenance, and care instructions after installation.
Plants, landscapes & living systems
Plants and ecological landscapes are living systems affected by weather, irrigation, soil conditions, pests, disease, wildlife, storms, freezes, flooding, drought, maintenance practices, and other factors outside Bring Back Eden's control.
Unless expressly guaranteed in writing, Bring Back Eden does not guarantee permanent plant survival, specific harvest quantities, exact fruiting dates, specific growth rates, storm survival, exact mature appearance, specific food production, specific water savings, or a particular property-value increase.
Plant loss or landscape decline caused by inadequate watering, irrigation failure, overwatering, chemical exposure, neglect, weather, pests, wildlife, disease, third-party work, or failure to follow care recommendations may not qualify for replacement.
Weather, site conditions & third parties
Bring Back Eden is not responsible for delays or losses caused by circumstances reasonably outside its control, including hurricanes, tropical storms, flooding, freezes, extreme heat, drought, supply shortages, nursery shortages, government restrictions, utility interruptions, or other force-majeure events.
Third-party contractors, suppliers, nurseries, irrigation providers, engineers, and other independent providers are responsible for their own work. To the fullest extent permitted by law, Bring Back Eden is not responsible for losses caused by concealed or undisclosed site conditions, defective existing systems, inaccurate information supplied by the client, natural events, or work performed by others.
HOA, permits & approvals
Unless specifically included in writing, clients are responsible for determining and obtaining required HOA approvals, municipal approvals, permits, variances, and other permissions. Bring Back Eden does not guarantee that a design or project will be approved by an HOA, municipality, permitting agency, or other authority.
Warranties
Except for warranties expressly provided in writing, this website does not create any additional warranty or guarantee. Any project-specific plant warranty, workmanship warranty, manufacturer warranty, or other written warranty controls over these general terms.
Limitation of liability
To the fullest extent permitted by applicable law, Bring Back Eden will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages, including lost profits, lost harvests, lost use, lost business opportunities, or similar economic losses.
To the fullest extent permitted by law, Bring Back Eden's total aggregate liability arising from a specific service, project, transaction, or occurrence will not exceed the amount actually paid to Bring Back Eden for the specific service giving rise to the claim during the three months immediately preceding the event giving rise to the claim, or the amount paid for that specific one-time service, as applicable. Nothing in these terms limits liability that cannot legally be limited or excluded.
Indemnification
To the fullest extent permitted by applicable law, clients are responsible for claims, losses, or expenses arising from materially inaccurate information they provide, undisclosed hazards, unauthorized modifications, third-party work, failure to obtain approvals for which they are responsible, or misuse of Bring Back Eden designs, plans, or materials. Any indemnification obligation remains subject to applicable law and the applicable written project agreement.
Digital products & intellectual property
Digital guides, educational materials, plans, graphics, photographs, videos, and other original Bring Back Eden materials are protected intellectual property. Unless another license is expressly provided, digital products are for personal use and may not be resold, redistributed, copied for commercial use, or publicly reproduced without permission.
Digital purchases are generally final once delivered, except where required by law. Purchasing a design does not automatically transfer copyright or unrestricted reproduction rights. Clients may use project deliverables for the property or project for which they were created unless otherwise agreed in writing.
Website & educational disclaimer
Website articles, videos, guides, newsletters, social-media content, renderings, projections, and educational materials are general information and are not substitutes for a property-specific professional assessment. Illustrative future-growth images, conceptual renderings, and projections are not guarantees that a property will develop or appear exactly as shown.
Nothing on this website guarantees a specific landscape, agricultural, financial, health, or property outcome unless expressly stated in a signed written agreement.
Photography & client privacy
Bring Back Eden may document its work for internal records and quality control. These general terms do not provide blanket permission to publicly identify a private client, private residence, household, or private address. Identifiable client testimonials, family images, or private-property details are only used publicly with appropriate permission.
Cancellations & rescheduling
Cancellation, rescheduling, deposit, refund, and payment terms may vary by service and will be provided through the applicable booking page, invoice, proposal, or agreement. Weather, safety concerns, site conditions, or circumstances outside Bring Back Eden's reasonable control may require rescheduling.
Disputes, attorneys' fees & collections
The parties are encouraged to make a good-faith effort to resolve disputes directly before formal litigation and may use mediation where appropriate. Florida law governs these terms, without regard to conflict-of-law rules. Unless a signed agreement says otherwise, any lawsuit must be brought in the state courts located in Manatee County, Florida.
In any lawsuit, arbitration, or other proceeding arising out of or relating to these terms, a purchase, or services provided by Bring Back Eden, the prevailing party is entitled to recover its reasonable attorneys' fees, paralegal fees, and costs, including on appeal and in any proceeding to collect or enforce a judgment, to the fullest extent permitted by law.
Past-due balances may accrue interest at the rate stated in the applicable invoice or agreement, never exceeding the maximum rate allowed by Florida law. If an unpaid balance is referred for collection, the client agrees to pay reasonable collection costs and attorneys' fees, whether or not a lawsuit is filed, to the extent permitted by law. Bring Back Eden may pause or suspend work on accounts that are past due.
A project-specific agreement may contain additional provisions concerning dispute resolution, mediation, venue, attorneys' fees, or other legal matters, and controls where it differs from this page.

Severability
If any provision of these terms is found invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
Changes to these terms
Bring Back Eden may update these website terms from time to time. The terms in a signed agreement for a specific project remain controlling for that project where they differ from these general website terms.
